Orr Appeal (continued from page 7) Lifeline attorney, provided a list of at least 30 issues that will be raised in the appeal on which he claims the Superior Court judge was either incorrect in his original ruling, or that he failed to address in that ruling. For instance, Chai Lifeline claims the judge was incorrect in finding that the subject property was only available to Chai Lifeline members. Another claim is that the judge’s finding that the zoning board made a careful assessment of the effects of the proposed use on the neighboring community is irrelevant as to whether those using the property are “families” under the township’s ordinance. Chai Lifeline also claims the judge failed to address the vagueness of the zoning ordinance because it does not identify how long a family has to reside at a single-family home to comply with the ordinance, and that the judge misinterpreted the definition of “inherently beneficial use” in the state’s municipal land use law. Liebman estimated that it could take six months to a year before a decision on the appeal is rendered by the court, and the litigation could be stretched out further if the appeal is taken to the New Jersey Supreme Court.
