Sign ordinance
(continued from page 7) of the township by not permitting a lot of signs in the public rights of way and on public property. “Just imagine what it will look like in Mahwah if we don’t do something,” Williams said. Mahwah Township Administrator Brian Campion advised the council that the new ordinance was proposed to make it easier to enforce. He said if the council adopts the ordinance it would be enforced. But Roth said there needs to be clarity on who enforces it. Campion replied that the ordinance is part of the zoning code, so anyone who can enforce the zoning code and issue summonses for violations could enforce the sign ordinance. Larson questioned the extent of the prohibition in the new ordinance. Fede advised that the new ordinance would remove the council’s ability to approve applications for the posting of temporary signs, which would result in a total ban on temporary signs in the rights of way and on public property, including signs posted by Realtors and charitable organizations. “Anything other than a full ban will potentially result in lawsuits,” Larson said. Williams moved to adopt the new ordinance, and Alderisio seconded the motion. However, Roth and Larson reiterated their position that the council should not vote on this ordinance until the full council is present. Williams and Alderisio withdrew their motion, and the matter was carried.
