(continued from page 4) Councilman William Smith advised Barbara that the method used by Leposky to determine the assessments has been accepted by the courts in the past. He acknowledged, however, that no method is 100 percent accurate, and the only other method would have been to appraise the properties before and after the road improvement and that method would have been too expensive. Smith said he feels the method used by Leposky is the fairest and Borough Attorney Richard Lustgarten said the use of frontages in determining the special assessments reached the goal of systemic uniformity. Lustgarten also emphasized that the procedure used to determine the assessments is not legally deficient and the tax assessor applied the appropriate standard in determining the special assessments. “Nobody is ever satisfied with a special assessment,” Lustgarten told Barbara, “but we try to reach systemic uniformity. Your offer was reviewed but, at the end of the day, we must rely on Mr. Leposky’s assessment and he reviewed your assessment and felt it was fair.” Councilman Michael Friscia was the lone councilperson to voice a negative opinion about the method of determining Barbara’s assessment and the lone vote against passing the resolution. “It doesn’t strike me that the procedure is fair,” Friscia said, “and there needs to be a different approach.” When Mayor Frank Bivona asked Friscia for suggestions, he said he was not aware of what other approaches might be available other than appraising the properties before and after the improvement is made. Smith suggested the council pass the assessment resolution and, if any of the property owners contest their assessments, the council would be in a better position to reconsider difficulties related to individual properties. “I understand Mike Friscia’s concern, and I am not happy with it either,” Smith said, “but there is no other way available to us.”
