(continued from page 3) fails to adequately provide for open space, recreation, and pedestrian opportunities; and it contains no analysis of the impact of the development on the Ramapo River trail. In addition, the lawsuit states that 20 acres set aside for passive recreation are located in a floodplain and could not be developed by law; the township failed to comply with state law concerning the proper notice of the public meetings on the rezoning ordinances; the township failed to provide adequate reasons in its minutes and on the record for adopting the rezoning ordinance after it was found to be inconsistent with the township’s master plan; and the township council used its zoning power to benefit a developer’s private interest rather than the community’s interest. The lawsuit also states that one of the ordinances arbitrarily collects fees from the developer for transportation improvements within the township without providing a mechanism for providing transportation improvements on adjacent roads that are not within the township; the council failed to fully comply with the statutory requirements for adopting an ordinance that is consistent with the township’s master plan; the Mahwah homeowners’ petition was rejected by the township clerk without a valid basis; and, despite the petition, the ordinances were adopted without the number of votes required by state law.
