McMahon The developer who previously tried to get the Mahwah Zoning Board’s approval for a self storage facility in a GIindustrial zone is now proposing an assisted living facility for the same site. Zoccoli Associates is seeking a use variance and several other variances and waivers to build an 86,175 square foot, three-story building on the south side of the 4.6-acre property with frontage on Edison Road. The applicant would also subdivide the existing 10-lot residential portion of the property, which has frontage on Fairmount Avenue. Those lots are in the R-10 residential zone, and Zoccoli wants to subdivide them into five lots to form a buffer between the assisted living facility and the residential area on the north side of Fairmount Avenue. There is an existing residential lot on Fairmount Avenue that extends into this industrially zoned property, and the new residential lots would be adjacent to both sides of that existing lot. According to Stephen Sinisi, the attorney for Zoccoli Associates, if the application were approved, the developer would seek a licensed operator or management company to operate the assisted living facility. Frank Miletto, the architect who designed the facility for Zoccoli, testified at the zoning board’s last public meeting. He described the 96-room building, which would have a porte-cochere, or covered entrance, at the front of the building on Edison Road. The building would have the same appearance on all sides. The first floor plan shows a front desk for security and control and an elevator in the middle of the building, with lounge areas, offices and meeting rooms, a beauty parlor and barber shop, a kitchen, library, a quiet room, a fitness room and medical suite, a community dining room, and 24 single occupant suites with toilets on both sides of a center corridor. At the rear of the first floor, there would be a large community room leading to a covered porch. Staircases would be located at both ends of the building, and the second and third floors would each contain 36 single occupant suites with toilets on both sides of a center corridor. The facility would operate 24 hours a day, seven days a week and would have about 25 to 30 staff members on duty during each shift or about four staff members for each resident. There would be 49 parking spaces in a parking area that would extend to the eastern end of the property and which would comply with the state’s residential site improvement standards, which requires one half parking space for each room in the facility. One of the concerns expressed by board members was the responsibility of the operator of the facility to obtain or provide its own professional ambulance service so the local volunteer ambulance corps would not be required to service the facility. Sinisi said he would be remiss to speak for the eventual operator of the facility, but Miletto told the board that hospitals compete for this type of service and the operator of the facility would not use the township’s volunteer services. Another concern expressed by board members included the number of proposed parking spaces. They suggested the number be increased. They also suggested that deliveries be made to a rear door to the kitchen. Nadine Legarde, the owner of the existing developed residential lot, told the board she wants the dumpster location moved away from her back yard. She also questioned the accuracy of the parking area setback to her property. Another Fairmount Avenue resident, Kimberly Tanis, pointed out that school buses stop at the area that had been the paper street part of Jefferson Street. She asked about the future use of that grassy area, and was told it will be kept in its natural state. In 2005, Zocolli sought the board’s approval for a self storage facility on the part of the property that is zoned for industrial use, but faced opposition from neighbors who hired an attorney to represent them.
