Rezoning
(continued from page 3) the master plan. While the board is supposed to plan for the future, he said, the state’s municipal land use law in this case doesn’t authorize them to do so. Michael Richards of Blue Ridge Lane advised the board that he had formed a group to oppose the rezoning. He said he had a petition signed by 250 residents who oppose the move and want the Mahwah Council to permit a non-binding referendum to be held to allow all the residents of the township to voice their opinion on the matter. James Jaworski, the attorney for Crossroads Developers LLC, the owner of the property, said after the meeting that he was satisfied with the action of the planning board. “I think the planning board did the job they were entrusted to do and, hopefully, the site will get rezoned and the board will get an opportunity to look much, much closer at this site in the future.” The township council is expected to consider adoption of the ordinances at its March 31 public meeting. Burgis pointed out that the council can adopt the ordinances even if they are inconsistent with the master plan by stating their reason for doing so and by a majority vote of the council.
