(continued from page 9) Court ruling in another township lawsuit found that the board was not required to hold a public hearing, or allow public questions, during its review. He said the board can decide whether to permit public questions or comments. After a brief discussion, the planners decided that the board will make a determination about allowing public questions and comments about the ordinances at the meeting on March 14 when it becomes apparent how many members of the public want to question the board or make comments on the ordinances. In February, the township council introduced the three ordinances by a 4-3 vote after five lengthy public meetings during which the details of the ordinances were discussed and many members of the public voiced their opinions, mostly in opposition, on the proposed rezoning of the Crossroads property. The four council members who voted in favor of the ordinances, Samuel Alderisio, John Roth, Roy Larson, and Council President John DaPuzzo, explained that the current office park zoning of the property could permit up to 5,000 jobs with the potential of placing more students into the local school system and could create more peak hour traffic congestion. They also pointed out that the township would receive more than $2.1 million in potential tax revenue from the redevelopment of the site; $4,050,000 million from the developer as a result of the impact fees that would be paid by all the retail, office space, and hotel owners who locate at the site; and a minimum of $2 million in construction permit fees. Lisa DiGiulio, John Spiech, and Harry Williams, the three council members who voted against the introduction of the ordinances, voiced concerns about the potential increase in traffic the retail center would create without addressing the existing highway traffic congestion, the impact of the rezoning on the character of the township, and the other zoning problems that currently face the township that could cause additional traffic problems. Once the planning board’s opinion about the ordinances is sent to the township council, the governing body will schedule public hearings and a potential adoption date. If adopted, the developer would then be required to file an application with the planning board to obtain site plan approval and any variance or waiver approvals.
