(continued from page 4) Attorney Scott Lippert, who represented the Filippones in the lawsuit, claimed the board’s decision that his clients were required to serve notices to property owners within 200 feet of both his clients’ property and the property with the easement was arbitrary, capricious, and erroneous as a matter of law. He asked the court to reverse the board’s decision and remand the application to the zoning board for further public hearings and a final disposition on the merits of his client’s application. According to the Filippones’ plan, their landlocked property would be accessed by a 12-foot wide driveway partially within a 25-foot wide access easement that would extend over Venusti’s property to Midvale Mountain Road. Venusti has been contesting the Filippones’ plan for several years, but the Filippones won the right to that easement in Superior Court in 2007 when Judge Robert P. Contillo ordered the imposition of a five-foot wide permanent pedestrian easement over the Venusti lot and ordered the creation of a temporary 25-foot wide vehicular easement over the Venusti lot to allow the Filippones to apply to the zoning board for a variance to develop their property. That court decision provided, however, that the Filippones must procure all the approvals for that development within four years, or by Aug. 15, 2011, or the temporary vehicular easement would expire leaving the permanent pedestrian easement in place.
Residents receive CERT training
Fourteen Mahwah residents recently completed the CERT training course sponsored by the Bergen County Office of Emergency Management. Graduation ceremonies were held at the Bergen County Law and Public Safety Institute in Mahwah. The graduates participated in an eight-week course that provided basic skills and information on what to do before, during, and after a disaster to aid themselves, their families, and their community.
