McMahon The Township of Mahwah recently held a sealed bid auction of a vacant townshipowned lot that is no longer required for public purposes, but no interested bidders came forward. The corner lot is located at the intersection of Third Street and Avenue A in the northern section of the township near Route 17, and it is overgrown with vegetation. The lot conforms to the local zoning requirements, and the building envelope of a potential house on the property would have the appropriate 25 foot setbacks from both streets. The auction was advertised in January after the township council adopted an ordinance permitting the municipality to sell the property at auction. Brian Campion, the township’s business administrator, recently advised that the contiguous property owner who had expressed an interest in buying the property to add to his lot, apparently decided not to bid on it when he learned that the 50 foot by 150 foot lot in the R-11 zone conformed to the zoning requirements in that zone. According to Campion, that means the lot could be sold as a conforming singlefamily building lot, and the property would be valued as a separate building lot. Campion also explained that the R-11 zone permits two-family structures on lots with a minimum size of 11,000 square feet, a lot width of 80 feet, and a lot depth of 100 feet. The property was offered for sale to the highest bidder among contiguous property owners, with a minimum bid of $100,000. The sale was to have been accomplished according to the state’s local lands and building law. However, Campion explained that the contiguous neighbor apparently thought the property was just excess land that could be added to his property and did not want to bid on a lot that was valued as buildable property. Campion advised the township council of the results of the auction at a public meeting, and the council decided that, in light of the fact that no bidder came forward, it would re-advertise the property for sale and hold another auction in April. “The property is under three feet of snow right now,” Council President John DaPuzzo remarked, “so I agree with Brian that we should wait until the spring when it will be more marketable.” The property was not included in the recent revaluation of all properties in the township because it is tax exempt as a township-owned property. The unimproved lot has an assessed value of $97,900. The adjacent improved lot on Avenue A to the north was assessed at $217,800 prior to the recent reassessment, and the other adjacent lot to the west on Third Street was assessed at $239,100. Those two lots are now assessed at $249,600 and $320,900, respectively. Other comparable properties near this lot, which have been improved with single-family dwellings, were reassessed at values of between $308,000 and $364,400, depending on the size of the livable areas of the homes on those properties. Campion pointed out that the sale of the lot would bring immediate revenue to the township and would create a new tax-producing property in the township.
