McMahon A Superior Court judge has ruled that Mahwah is entitled to a declaratory judgment in its motion for summary judgment pertaining to a lawsuit the township brought against K. Hovnanian at Mahwah VI Inc. to retain the low- and moderate-income senior citizen designation of the 75 residential dwelling units at Norfolk Village. Those residences are located east of Franklin Turnpike and are accessed from Fox Lane. Superior Court Judge Brian R Martinotti ruled that the units must remain senior citizen housing, except for one unit that may be rented to a non- senior citizen who is income eligible as an on-site superintendent, in keeping with the April 1993 Mahwah Planning Board resolution approving the housing development. Martinotti also ruled that the units must remain income restricted until 25 years after the date on which a certificate of occupancy was issued for each unit, subject to the further restrictions of the state’s administrative code that may apply upon the expiration of the restrictions on each unit. The judge enjoined Hovnanian and its officers, agents, attorneys, employees, successors, transferees, and assigns from directly or indirectly taking any action to rent and/or sell any Norfolk Village housing units to persons who are not senior citizens, except the superintendent’s unit, until 25 years after the date that a certificate of occupancy was issued for each unit, or to persons who are not qualified by the township for affordable housing in Mahwah, subject to further restrictions of the state’s administrative code. Judge Martinotti further directed that Hovnanian and its officers, agents, attorneys, and employees must immediately begin to cause the vacation of any units occupied by non-senior citizen or non-income qualified tenants, or both, and denied Hovnanian’s cross motion for summary judgment.
