Landscaper registry ordinance updated, reintroduced
by Jennifer Crusco Responding to concerns expressed by the New Jersey Landscape Contractors Association, the Ho-Ho-Kus Council updated its proposed registry ordinance so certified landscapers would be exempt from filing with the borough clerk. The updated ordinance was reintroduced at the council’s last public meeting and will be considered for adoption at the March 22 council session. “The intent is not to penalize contractors, but to have them file with the clerk,” Ho-Ho-Kus Borough Attorney David Bole explained. The council recently introduced the proposal to have landscapers who work within Ho-Ho-Kus register at borough hall. However, the original proposal was tabled for review and refinement after the council heard from the association. Bole explained that the association asserted that home improvement contractors are already required to register with the state, and the state’s regulations supersede any municipal requirements. The bottom line, he said, was that the contractors did not wish to pay the borough’s fee, which would be $10 per year. The attorney drew a distinction between home improvement/landscape contractors and companies that are mainly involved with cutting and fertilizing lawns and providing spring and fall cleanup services. The updated ordinance reflects that distinction. Bole noted that registries, such as those now in effect in Ridgewood and Franklin Lakes, allow municipalities to maintain a roster of contractors and their contact information. The updated proposal, Ordinance 985, states that the purpose of the ordinance is “to require certain landscape contractors to register with the borough to ensure that the borough knows the name of such landscape contractors performing services within the borough to assist residents seeking to avoid those who engage in improper or unscrupulous business practices since the borough determines that it is in the best interest of the health, safety, and welfare of its residents for this protective measure.” The amended definitions in the ordinance include one for “exempt landscape contractor,” which refers to a landscape contractor who is registered as a home improvement contractor pursuant to the Contractors Registration Act, NJSA 56:8136 et seq. and its regulations. A borough official previously explained that the move toward registration was prompted by the desire to have some control over where and when contractors place fall leaves out for pickup. Concerns associated with the practice of piling leaves in the street include the narrowing of the borough’s roadways, which is a safety issue, and the negative effect the acidity of the leaves has on local waterways.
