June 8, 2011 THE VILLADOM TIMES III • Page 3 Ho-Ho-Kus Zoning and planning fees updated by Jennifer Crusco The Ho-Ho-Kus Council recently approved an ordinance that updated existing fees for planning and zoning board applicants and established some new charges. Under Ordinance 988, applicants seeking minor subdivisions or re-subdivisions will be required to pay a $350 filing fee and an additional $350 in escrow for each lot to be created by the minor subdivision. The newly-approved ordinance raised both of those fees from $300. Applications to either the planning board or the zoning board of adjustment for minor subdivisions that involve a hardship variance will include a $400 filing fee, while use variance requests will carry a $450 fee. The fees for these requests had previously been $300 and $350, respectively. Non-residential variances will be billed at $1,000. This is a new fee. Applicants seeking major subdivisions will be charged a $500 filing fee (up from $400) plus $100 for each lot to be created by the subdivision and an escrow of $350 per lot to be created. The $100 and $350 charges are unchanged from the fees that were previously billed to applicants. However, major subdivision applicants who request a hardship variance will now pay a $400 filing fee (up from $300), and those who seek a use variance will now pay $450 (up from $350). A new fee of $1,000 has been established for those seeking a non-residential variance in association with a major subdivision. The cost of a zoning chapter interpretation pursuant to NJSA 40:55D-70b will remain $175. However, a $150 filing fee has been established for planning board review for a new business. The ordinance also raises the cost of a use variance pursuant to NJSA 40:55D-70d to $450. The cost had pre- viously been set at $350. Zoning board applicants whose cases concern matters other than use variances will pay a $400 fee (up from $300), and zoning board applicants whose cases involve non-residential properties will now pay the newly-established fee of $1,000. Borough officials stated that this ordinance was updated in an effort to bring the fees charged by Ho-HoKus in line with those of other local communities.
