The use variance was required because cellular towers are permitted uses only on municipally-owned property. Because the board’s decision is expected to be appealed, the board took two votes on the application. The first motion, which was to approve a 120-ft. pole, failed with a 3 yes, 4 no vote. The board felt that the property was already overburdened and would require a number of additional variances, including for parking, if the monopole were to be sited at the proposed location. The equipment pads needed to support the monopole would eliminate parking spaces and exacerbate the parking shortage in popular shopping center areas. The proposed location of the structure in the center of town was also cited as a detriment. The board also voted on a 100-ft. monopole, since the original application had been for a 100-ft. structure and had been amended at the suggestion of the board to accommodate more that the two locators. This time, four members voted for the application, but it was still denied because it failed to receive the required five affirmative votes. A decision on the application had been deferred because the board wanted to hear additional testimony from radio frequency experts as to whether DAS (distributed antenna system) technology could be used instead of a monopole to provide the needed coverage. Both the applicant’s expert and the board’s agreed that too many variables remained unresolved for them to be able to recommend its use for this particular application. The applicants had originally filed separate applications for 90-foot towers, with T-Mobil seeking permission for its antenna in the parking lot of the adjacent building at 44 Godwin Avenue. The board recommended the joint venture. Cellular towers are permitted uses only on municipally-owned property.
