Rigo also found that the revised regulation suffers from the same infirmity as the original regulation in that state law limits the school’s authority over off-school grounds conduct to conduct that materially and substantially interferes with the requirements of appropriate discipline in the operation of the school. “There must be some link between the conduct and the school environment,” Rigo stated. Superintendent Lauren Schoen responded by pointing out that the prior decision of the acting commissioner of education which confirmed an administrative law judge’s recommendation that the regulation gives the school board authority that is beyond the scope of the state’s governing regulatory provisions and its enforcement would, therefore, be unlawful, is before the Appellate Division of Superior Court. The board, nevertheless, revised its extracurricular regulation accordingly. She also pointed out that the board’s revised regulation was again challenged regarding its requirement that students who are arrested or charged with a violation of law due to conduct away from school meet with the administration to determine whether the student engaged in conduct which violated the behavioral expectations in the policy. “Now an administrative law judge issued a decision finding that even a meeting between the student, his or her parents and the administration would violate the state regulation,” Schoen stated. “The school board strongly disagrees with this decision and is filing exceptions to the commissioner of education,” Schoen stated. “The board continues to support its original extracurricular policy, as well as the student conference requirement in the original and revised policies, and it looks forward to presenting its appeal to the Appellate Division of Superior Court and its exceptions to the most recent decision to the commissioner.”
