(continued from page 12) that he has stated repeatedly on the record that it has long been the practice of the planning board to permit medical office uses in the retail business zone. He also pointed out that Cook’s client has several tenants who run medical offices where procedures, surgical and non-surgical, are performed and yet his client continues to push his objections to his client’s application. While Spizziri said he could not respond to Cook’s claims regarding jurisdiction because he had not yet reviewed the information that Cook provided, he said there may be other relevant cases besides the one to which Cook is referring. But he acknowledged that Cook’s questions were of a serious nature, and he suggested the public hearing be continued until another date. The board agreed to move the public hearing to May 4. Tice Road Properties, LLC, wants to build a 16,000 square foot medical office and ambulatory surgical center on two lots in the RB retail business zone at the end of Tice Road. The building would have 12,000 feet on the lower level for the ambulatory surgical center, which could include urology, gastroenterology, podiatry, obstetric/gynecological, pain management, and plastic surgery services that do not require overnight hospital stays, and 4,000 square feet on the upper level for medical office space. Both levels would have access from the grade level of the building due to the slope in the property and there would be a maximum of six operating rooms in the surgical center.
