Mahwah November 10, 2010 THE VILLADOM TIMES IV • Page 7 Dogs may be prohibited at recreation facilities by Frank J. McMahon The Mahwah Township Council has introduced an ordinance that would, if adopted on Nov. 11, make it unlawful for any person to allow a dog to enter upon or use any recreational facility so designated in the township code. Council President John DaPuzzo pointed out that dogs are being brought to recreational facilities with increased frequency, causing unsafe and unsanitary conditions to develop. He explained the need for the ordinance as a means to protect public health, safety, and welfare, noting that people are not cleaning up after their dogs. The ordinance would amend Chapter IX, Section 9-1.4 of the township code to prohibit anyone from allowing a dog on a designated recreational facility. It would also amend that section to make it unlawful for any person to allow any hoofed animal, specifically horses, to enter or use Continental Soldiers Park on Ramapo Valley Road opposite Ramapo College, at any time. Prior to this ordinance, a 2007 ordinance just made it unlawful for a hoofed animal, specifically a horse, to enter Continental Soldiers Park. Hoofed animals, or ungulates, are part of several groups of mammals, most of which use the tips of their toes to sustain their whole body while moving. They make up several orders of mammals, of which six to eight still survive. Some commonly known examples of ungulates living today are the horse, zebra, donkey, cow, rhinoceros, camel, hippopotamus, goat, pig, sheep, giraffe, deer, antelope, and gazelle. The township’s designated recreational facilities include the following areas and the grounds surrounding them, the structures and buildings in those areas, and the areas adjacent to them which are set aside for the parking of vehicles and bicycles: Commodore Perry Complex; Winter’s Park and Pond Complex, excluding the commuter parking lots; the Airmount Complex, including the pond; the Riverside Park Complex; the Fardale Complex; the Stag Hill Complex; Continental Soldiers Park; Airmont Park; Ridge Road Park; Mary Patrick Park; any school facility designated the responsibility of and sponsorship of the recreation commission; any other township-owned or leased property so designated; and any future properties so designated as a recreational facility. This section of the code also makes it unlawful for any person to enter upon or use those recreational facilities or the grounds or buildings on them, or to park any vehicle on them, except between the hours of 7 a.m. and 11 p.m., prevailing time, except that the closing time will not apply to persons who are specifically engaged in a permitted activity or sport approved by the township. It also prohibits any person from engaging in hawking, peddling, or vending of any foods, beverages, or confec- tions of any nature or description in Continental Soldiers Park during such times that a licensed concession stand is open for business. In addition, this section specifically prohibits smoking on or around any recreational facility designated in this section.
