He is survived by his siblings Mary Bollatto, Alfred and Joseph Kozakiewicz, and many nieces and nephews. He was predeceased by his wife Cissy Konefal, his parents Antoni and Magdalena Kozakiewicz, and his siblings Sophie Drobesh, Stephen, Carl and Wallace Kozakiewicz. He was a contractor and built many homes in Mahwah. He was a member of the Ramapo Masonic Lodge and a past master. He is survived by his children Dolores Moody of New York City, and Robert Lipham of Nokomis, Florida, six grandchildren, and eight great grandchildren. He was predeceased by his wife Muriel. E. Robert “Bob” Litchult Jr. of Bradenton, Florida, formerly of Ramsey, died March 11. He was 97. Before retiring, he worked at Citizen’s First National Bank. He was a member and former chief of the Ramsey Fire Department, which he served for 76 years. He is survived by his daughter Shirley Leonard of Bradenton, Florida, two grandchildren, one great grandchild, and his siblings Lillian Abelman, and Willard W. He was a member of the Knights of Columbus, Council # 5257. He is survived by his children John of Bedford, New Hampshire, Regina of Ridgewood, Joan of Ridgewood, and Edward of Nashua, New Hampshire, six grandchildren, and his sisters, Annarose Lilla Rendine of Vernon, Natalie Mazzacca of Hawthorne and Mary May of Washington Township. Weiner concurred with Zisgen’s position and argued that the notice Filippone provided did not properly explain his plans. In response to the urging of Zoning Board Chairman George Cimis and Zoning Board Attorney Ben Cascio, Filippone retained Scott Lippert to explain to the board why his notice was valid. Lippert argued that the legal case Zisgen was referring to involved an access road to a 231-unit development and not a driveway to a single house. He claimed that, under the state’s residential site improvement standards, a driveway is not considered a road and, therefore, that case did not apply to the Filippone application. “It’s a completely different set of facts,” Lippert said, adding that he did not think a court would extend that case to this application. He also complained that the issue was raised by Zisgen after 11 months of public testimony on the application. In addition, he claimed that the notice Filippone gave to his neighbors met the requirements of state and he suggested that the public hearing continue with the understanding that his client would proceed at his own risk if the matter is approved and it is appealed in Superior Court. After much discussion, the board decided that the notice was not deficient in its information, but that it should have been provided to all property owners within 200 feet of those properties within 200 feet of the easement and of Filippone’s property and, therefore, the board did not have the jurisdiction to proceed. Cascio explained after the meeting that the public hearing has been terminated, but the application was not dismissed and it remains pending. He said Filippone will now have to prepare a new notice and send it to all appropriate property owners before a new public hearing can be scheduled.
