Council withdraws business rezoning ordinance

McMahon The Mahwah Township Council has withdrawn a proposed ordinance that would have revised the zoning of 30 lots on Franklin Turnpike between East Ramapo Avenue and King Street, and two lots on Franklin Turnpike near the Ramsey border. The rezoning of these properties to a new B-80 commercial business zone had been recommended by Joseph Burgis, the township’s professional planner, and the township’s planning board subsequently recommended the adoption of the related ordinance. The board found the proposed measure consistent with the goal of the township’s master plan to improve and upgrade traffic circulation, although not entirely consistent with the township’s master plan. The concerns expressed at the public hearing of the ordinance by the property owners who would be affected by the rezoning could lead to substantial changes in the ordinance. As a result, the council decided to withdraw the ordinance and to ask Burgis to review those concerns and then attend a special meeting of the council in July to discuss them with the council when the concerned property owners are in attendance. The ordinance was intended to change the zoning of two lots in the GI-80 industrial zone near the Ramsey border, which is currently occupied in part by Liberty Corporate Travel, and all the lots in the GI-80 and B-10 business zone on Franklin Turnpike between East Ramapo Avenue and
King Street to a new B-80 zone that would permit various types of retail businesses. The attorneys for two owners of the Franklin Turnpike property between East Ramapo Avenue and King Street voiced separate concerns about the rezoning, and both were satisfied that the ordinance was withdrawn and will be reconsidered. Attorney Carmine Alampi told the board that, two years ago, his client, Mahwah Town Center LLC, purchased four acres of the Franklin Turnpike property between East Ramapo Avenue and King Street including the post office property, the flower shop, pizza bar and restaurant, and the bank next to it, but not the vacant bank building at the (continued on page 14)
