He complained that the 80,000 square foot minimum lot size requirement in the ordinance and its 75-foot setback requirement would create problems for his client who wants to develop the property into a community of small shops and stores in phases. He also urged the council to consider adding a generic financial institution use and personal service uses to the list of permitted uses in the new zone so it would not be necessary to return to the zoning board of adjustment for variances for any new variations of those uses that may be created in the future. Councilman Samuel Alderiso cautioned, however, that a general personal services use could lead to undesirable uses being proposed for the area in the future. Councilwoman Lisa DiGiulio also questioned if this area could handle the potential traffic from the new retail development. “I don’t know how much traffic that area can hold,” she said. Maureen Postolowski owns 10 of the 30 lots between East Ramapo Avenue and King Street. Her home is located on eight of those lots, which are currently in the GI-80 general industrial zone. Her attorney, Bruce Whitaker, explained that his client’s property is not conforming to the GI-80 zone and the new ordinance would keep her property non-conforming, which Postolowski believes is unfair. He supported the council’s action to withdraw the ordinance and to have Burgis consider some inconsistencies in the measure. He pointed to one item prohibited by state law: the use of floor area to establish a parking requirement for a child care center. He also suggested that, if the minimum lot size were reduced from 80,000 to 60,000 square feet, the ordinance should grandfather someone who now has 80,000 square feet so the property does not become non-conforming. John Spiech, who was elected to the council in May and will be sworn in to his council position on July 1, suggested the council consider including single bedroom housing above the retail stores in the new zone inasmuch as school enrollment is dropping and there are fewer and fewer households with children. Councilman Harry Williams emphasized that the owners of all the properties that would be affected by this rezoning attend the special meeting. He also asked for a clarification of the planning board’s resolution recommending the zoning change which stated that it was not entirely consistent with the township’s master plan. A special meeting of the council was tentatively scheduled for July 29 subject to the availability of Burgis. Kevin J. Kenney Allen Meccia Robert McGarvie Robert A. Reuhl Joseph P.
