McMahon The Mahwah Township Council has adopted an ordinance that will limit off-street parking at the Pilot truck and gasoline fueling station on Route 17 South. The ordinance limits truck parking at the eight truck parking spaces to one hour during any 24-hour period, and provides for the enforcement of the ordinance by the Mahwah Police Department. The penalty for violation of the ordinance will be the same as that imposed for viola- tions of the state’s Title 39 traffic law. The ordinance also provides for Pilot to bear all the expenses, including engineering costs, associated with the installation of the related signs on the Pilot site in accordance with the directions of the township engineer. The council introduced and adopted this ordinance to satisfy the requirement of the zoning board’s resolution of approval for a conditional use variance for Pilot, which the board approved on Jan. 6. That resolution also included the requirement that Pilot request and consent to the enforcement of the Title 39 traffic law on the property which permits the local police department to enter the private property in order to enforce local traffic and parking regulations. The zoning board’s approval of the conditional use variance was challenged in Superior Court by Paks Fast Service, Inc., the owner of the Valero service station located north of the Pilot site, and by Parents for Safety, a non-profit organization created by parents of children who attend the schools located near the Pilot site. Superior Court Judge Joseph S. Conte affirmed the zoning board’s approval of the Pilot plan in an October trial of the Paks lawsuit. In a ruling last month, he again affirmed the zoning board’s approval during the trial of the Parents for Safety lawsuit. Meanwhile, Pilot has cleared its site and constructed the truck and automobile fueling service station. The business is currently open and operating. Neither Kevin Moore, the attorney for Paks Fast Service, Inc., nor Ira Weiner, the attorney for Parents for Safety, would comment on whether their clients intend to appeal Judge Conte’s affirmations of the board’s approvals of the Pilot plan and the conditional use variance.
