Fowl question
(continued from page 4) when she was a child. DeGroat said there was no point in time when there were no chickens on that property. Hubert DeGroat, who is DeMarino’s step-grandfather, also testified that he visited the property when he was 10 to 12 years old and, as far back as he can remember, there were always chickens on that property. Mulvey described the summonses that have been issued to DeMarino, and showed the board photos of the property, including the coops. He claimed that DeMarino previously owned a website known as the Ramapo Mountain Game Fowl Farm, implying that DeMarino used the roosters for something other than consumption or show birds, but that website has since been taken down. DeMarino, however, told the board he does not now have a website, and never had a website. Board member William Dator asked Cotz what he wants the board to approve, since it has no authority to overrule the board of health, which has an ordinance that prohibits roosters. Cotz replied that he is seeking a determination that his client has used the property in its current form since before 1946, and therefore has the right to continue the use of the property. He said such a determination would give his clients more standing before the board of health, even though a zoning board determination would not supersede a board of health ordinance. The public hearing was carried until the May 19 meeting of the zoning board.
