New ordinance increases allowable height for monopoles

McMahon A new ordinance adopted by the Franklin Lakes Council has increased the allowable height of telecommunications towers and antennas that are permitted in the borough from a maximum of 130 feet to a maximum of 170 feet including all antennas. The ordinance also permits the towers, antennas, and facilities located on property owned by the borough to be located within 300 feet of a residential zone. The ordinance was prompted by an application by Metro PCS New York, LLC, which wants to add its antennas onto the monopole currently located on property that contains the borough’s police headquarters on DeKorte Drive, the borough hall, the department of public works building, several recreation fields, parking areas, and access roadways and paths. In 1998, the borough approved a 130foot high monopole for this location with a maximum of three tiers of antennas: one for the borough and two tiers for future co-locators. Currently, three arrays of antennas are in place on the monopole, including those for the municipality and those for Sprint and Nextel. Metro would be the fourth carrier on the monopole. The monopole is located at the rear of the police headquarters adjacent to the northeast corner of the building. The property is located within the A-22.5 residential zone and is irregular in shape. Metro PCS New York, LLC’s application before the planning board proposes adding a new tier of six antennas on the existing monopole, which is currently 128 feet high. The new antennas would require a maximum height of 140 feet with the relocation of the municipal whip antenna to an elevation of 157.1 feet. In addition, Metro proposes to install equipment cabinets on a 10 foot by 12 foot concrete pad that would be located between the police department building and the existing Nextel equipment shelter. A cable bridge would be installed between the equipment pad and the existing monopole, and that cable would be routed within the monopole. There would also be underground electric and telephone service to a meter panel proposed for the location adjacent to the existing Sprint/municipal equipment enclosure. The application was scheduled to be presented to the planning board at its first meeting in September, but that meeting was cancelled for lack of a quorum. The case is now scheduled to be presented to the board on Sept. 15. The borough code permits wireless telecommunications towers, antennas, and related facilities as conditional uses, but only on properties owned by the borough and those properties in the RB retail business district; OB-RL office research laboratory district, which includes the Medco property; HOB-RL highway office building, research, and laboratory district, which includes the Becton Dickinson property; the I-1 and I-2 industrial districts, and properties consisting of 30 acres or more which are used solely for recreation and open space, but only during the time period that these uses continue to be the only uses on the property.
