McMahon The dispute over the Ramapo Indian Hills Board of Education regulation that bars students from extracurricular activities as a punishment for certain student conduct on or away from school grounds will soon be in the Appellate Division of Superior Court. At a public meeting last week, School Board President Wayne Peterson announced the board’s intention to appeal the recent decision by Rochelle R. Hendricks, the acting commissioner of education. Hendricks determined that the regulation gives the school board authority that is beyond the scope of the state’s governing regulatory provisions, and its enforcement would be unlawful. “The Ramapo Indian Hills Regional High School Board of Education met in executive session on Monday, Sept. 27,” Peterson announced. “We are making the necessary modifications to the regulation as directed by the acting commissioner of education. The board believes that the original regulation is in the district’s best interest, is valid, and will be appealing the acting commissioner’s decision to the Superior Court, Appellate Division.” Regulation 6145, which explains the consequences related to student conduct both on and off school grounds, was approved by the board in June 2009 and it sets down the requirements for district student conduct related to the use of alcoholic beverages and/or drugs, and compliance with the New Jersey Code of Criminal Justice and applicable municipal codes or ordinances, and specifies the potential for the loss of participation in extracurricular activities. The consequences of the regulation include the temporary revocation of the participation by the violating student in extracurricular activities, including sports and clubs.
