Subdivision gains Franklin Lakes planners’ approval

McMahon The Franklin Lakes Planning Board has approved a two-lot subdivision of a 71,448 square foot property in the borough’s A-22.5 residential zone that is bordered on the east by the Ewing Avenue ramp for Route 208 North. John Spencer, the applicant who represents the trust of Harold and Elizabeth Z. Spencer, proposed the subdivision with the demolition of all structures on the property and the removal of the existing driveway, utility pole, and the capping and sealing of an existing well. The two lots will be irregular in shape and fully conforming in area and configuration when the frontage is considered from Route 208.However, the two lots will be non-conforming in width, and one of the two lots will be deficient in its frontage from Haddon Place. Access to the existing property is via a single access driveway from Haddon Place. Spencer wants to build a new single family house with attached garage, septic system, storm water management system, retaining walls, and a new water line from Haddon Place on each lot with single access driveways from that street. The application required several variances, including one for the orientation of the proposed dwellings with frontage on Haddon Place and not Route 208, which would have conformed to the zoning ordinance. The subdivision does not require roadway construction or tree removal, but the individual lot development will require soil moving and tree removal permits for about 20 trees. The board approved several dimensional variances for the lots and imposed two restrictions on the subdivision. One was that the dwelling on one of the lots, identified as Lot A, would be 75 feet from the north property line. The other restriction was that the applicant would agree to abandon the existing access to Route 208 for both lots. Professional Engineer Robert Weissman, who prepared the subdivision plans for Spencer, advised that an existing fence that is owned by an adjacent lot owner, but which encroaches on the Spencer property along the southwest side yard property line, will remain in place with indemnification by the adjacent property owner. Before approving the subdivision, granting the vari-
ances, and imposing the restrictions, the board discussed the history of the existing access of the property to Route 208 and the existing setbacks on the property. The board members decided it was better to have the access to the two lots be from Haddon Place instead of Route 208 for safety reasons. Individual site plans for the specific houses to be built on the two lots will be submitted to the planning board for approval at a future board meeting.
