McMahon The Ramapo Indian Hills Board of Education has revised its regulation on extracurricular activities to bring �� it in line with state law. The revision was necessitated by Acting Commis�� sioner of Education Rochelle R. Hendricks’ finding that the district’s regulation #6145, which contains consequences related to student conduct both on and off school grounds, gives the school board authority beyond the scope of the state’s governing regulatory provisions. Hendricks also decided that enforcement of the regulation would be unlawful. The acting commissioner’s decision was issued in September in response to Administrative Law Judge Richard McGill’s recommendation that the commissioner nullify the district’s regulation. That regulation calls for the punishment of students who are arrested for conduct on or �� away from school grounds by temporarily revoking violating students’ participation in extracurricular activities, including sports and clubs. The revised regulation still contains all the sections in the original regulation, but it now contains a new section that reads: “Notwithstanding any provision of this or any other board policy or regulation to the contrary, no consequence shall be imposed upon a student for conduct occurring away from school grounds/events, unless the administrative personnel finding a violation of the policy and regulation as set forth above, also determines that the imposition of consequences as set forth above is reasonably necessary for the student’s physical or emotional safety, security and well-being, or for reasons relating to the safety, security, and well-being of other students, staff, or school grounds; and the conduct which is the subject of the proposed consequences materially and substantially (continued on page 11) �� CALL NOW! 201-652-4447 1973 - 2010 ~ 37 Years of Excellence MIDLAND PARK 24 Godwin Avenue �� Schwartz.
