Newly introduced ordinance includes fee increases

McMahon An ordinance introduced by the Franklin Lakes Council at its last public meeting would raise various borough fees ranging from construction permit fees, plumbing and electrical inspection fees, fire subcode inspection fees, demolition fees and certificates of occupancy fees to photo copying fees, escrow deposits, temporary sign fees, and fines for parking on posted property. Some of the construction code fees were raised last year. At that time, the borough’s construction fees had not been increased in 15 years and Franklin Lakes Borough Administrator Gregory Hart explained that the intent was to review these fees on an annual basis to place them on a par with the surrounding communities. Under this new ordinance, the building subcode fee for new construction would rise from 2.5 cents to 3.5 cents per cubic foot of building structure or improvement volume, with the minimum rising from $65 to $85 while the building subcode fee for new additions would rise from three cents to four cents per cubic foot of new volume, with the minimum rising from $65 to $85. The building subcode fee for renovations, alterations, or repairs would rise from $12 per $1,000 of the estimated cost of the project to $15, with the minimum rising from $65 to $85. Projects involving a combination of renovations and additions would be charged the sum of the two fees computed separately. The building subcode fees for in-ground swimming pools would rise from $12 per $1,000 of construction costs to $15, while the fee for above ground swimming pools would rise from $100 to $125 in addition to any electrical, plumbing, fire, fence, or soil moving fees. The building subcode fee for fences, retaining walls, and sheds would rise from $65 to $85, while the cost for annual permits will rise from $1,000 to $1,250 and the subcode fee for modular homes would rise from $200 to $250 plus foundation and service connection fees. Fees for plumbing subcode permits would also rise under this ordinance, with the fee for a water heater to increase from $35 to $45, and the fee for a boiler/furnace or steam boiler to rise from $50 to $65, while the subcode fee for a solar energy/heating system would rise from $70 to $90, and the subcode fee for gas piping would rise from $50 to $65, and the fee for each septic line would rise from $35 to $45, with the minimum for plumbing subcode inspections rising from $50 to $65. Electrical inspection fees would be $75 to $95 for one to 50 outlets, and $37 to $50 for each additional 25 outlets; $30 to $40 for each exterior condenser unit for residential central air conditioning, and $60 to $75 for commercial central air conditioning; $50 to $65 for above ground swimming pools, and $90 to $115 for in-ground swimming pools. Electrical inspection fees for a motion picture equipment booth would rise from $75 to $95, and the fee for radio and television transmitting equipment, CCTV, radio and television installations would rise from $45 to $50. The electrical inspection fee for X-ray units would rise from $25 to $35. Fire subcode inspection fees for fireplace and wood burning stoves would increase from $65 to $85, and the minimum fee for smoke detectors would rise from $65 to $85, with each additional detector over four rising from $10 to $15. The permit fee for demolition of a one- or two-family residence would rise from $100 to $125, and from $50 to $65 for accessory buildings to one- and two-family residence. That fee would increase from $200 to $250 for all other buildings. Certificates of occupancy would continue to cost five percent of new construction fees, but the minimum fee would rise from $50 to $65, while a certificate of continued occupancy, or a certificate of occupancy granted as a result of a change in use would rise from $100 to $125 and the fee for a certificate of occupancy upon the resale of residential property would increase from $50 to $65. The fee for a multiple certificate of occupancy would rise from $100 to $125 per unit or use included in the structure. The fee for a temporary certificate of occupancy would rise from $100 to $125. As a result of a recent Appellate Court decision, fees for copying public documents under this ordinance would decrease from 75 cents for the first 10 pages to three cents per page regardless of the number of pages requested. The actual postage cost for any discovery sent by mail would still be charged, and the cost for any envelope for discovery sent by mail would still be 25 cents. Any item that cannot be photocopied on the borough’s machine would incur the actual cost of making the copy. Copies of the borough’s zoning map would still be 75 cents per copy. This ordinance also carries a fee of $10 for non-resident participants in the boys’ and girls’ lacrosse programs in addition to the base fee, and a schedule of escrow deposits for legal, engineering, and planning fees for applications before the planning and zoning boards where applicable. The fee for temporary signs would rise from $20 to $40, and the fine imposed on a property owner or the owner’s agent or applicant for any violations of the regulations that pertain to temporary signs would rise from $50 to $200 for each day the violation continues to exist. Finally, the ordinance increases the fine for parking on posted property from not to exceed $15 to not to exceed $35.
