McMahon Administrative Law Judge Richard McGill has nullified the Ramapo Indian Hills Regional High School Board of Education regulation that would exclude a student from extracurricular activities if that student is formally charged and/or arrested by law enforcement for an alleged violation of the state’s code of criminal justice, or applicable municipal ordinances, on or away from school grounds. The ruling was issued on June 11 in response to a petition from Gregory and Theresa Meese, the parents of an Indian Hills High School senior who is a member of the National Honor Society and the Indian Hills Academic Decathlon team and will be attending the University of Virginia next year. The petition was filed last September to the state’s commissioner of education and it asked the commissioner to enjoin the regional high school district from enforcing the regulation that was approved by the regional board of education last June. The regulation set down the requirements for district student conduct related to the use of alcoholic beverages and/or drugs, and compliance with the New Jersey Code of Criminal Justice and applicable municipal codes or ordinances both on and off school grounds, and specified certain consequences for violating the regulation. Consequences included the temporary revocation of the participation by the student in extracurricular activities, including spots and clubs. The regulation pertaining to student conduct away from school grounds, especially regarding the use of drugs and alcohol, has been a controversial issue in the district since 2007 when a survey conducted by the school district indicated that students were often experimenting with alcohol and drugs away from school grounds. The school board took the position that it was compelled to take action. Two of the eight members of the board voted against the approval of the regulation, stating the board was overstepping its bounds and the regulation would not work because the district is never informed of a student’s arrest by the police because most students are minors and police will not confirm an arrest of a minor.
