McMahon The Franklin Lakes Borough Council has adopted a fee increase ordinance and introduced six other ordinances at its last public meeting. The newly approved ordinance will raise various fees, including those for construction permits, plumbing and electrical inspections, fire subcode inspections, demolition and certificates of occupancy, copying of public records, escrow deposits, temporary signs, and fines for parking on posted property. One of the six ordinances that was introduced would require the applicant or recipient of a planning board or zoning board of adjustment approval to prepare a deed in recordable form that includes the variances or conditions of development approved by the planning or zoning board. The deed must recite the board’s actions in granting the approval in order to give fair notice of the property’s status to any party who might be interested in the land in the future. Another ordinance would require that dumpsters and other refuse containers that are outdoors and exposed to storm water to be covered at all times. That ordinance would prohibits the spilling, dumping, leaking, or other type of discharge of liquids, semi-liquids, or solids from the containers into the municipal storm sewer system operated by the borough or into state waters. The third ordinance that was introduced would supplement the section of the borough code entitled “Sewers and Sewage Disposal” to require retrofitting private storm drain inlets that are in direct contact with repaving, repairing, reconstruction, resurfacing, or the altering of facilities on private property. The stated purpose of this ordinance is to prevent the discharge of solids and items such as plastic bottles, cans, food wrappers, and other litter into the municipal separate storm sewer system operated by the borough to protect the health, safety, and welfare of the public. The council also introduced a salary ordinance that states the salaries of the municipal employees and reflects the two percent salary increase recently approved by the borough and incorporated into the 2010 municipal budget. If adopted, the fifth ordinance to be introduced would rezone two properties currently located in the I2 industrial zone at the end of Tice Road next to the New York Susquehanna and Western Railway tracks immediately adjacent to Susquehanna Avenue. The two lots would be included in the RB retail business zone that fronts on Franklin Avenue and is adjacent to the I-2 industrial zone. The final ordinance that was introduced was reported on separately in Villadom TIMES last week. The article should have stated that Mayor DeNicola did not agree with the reappointment of the DPW superintendent and the recreation director.
