Highlands plan
(continued from page 3) under the Highlands plan. Phyllis Stewart of Blue Ridge Lane said she thought it would be good to opt into the Highlands plan. “I don’t want to see mountains raped by developers,” Stewart said. “If we opt-in, it gives us some protection against unscrupulous developers.” John A. Spiech, a member of the township’s planning board and environmental commission, said he thought it was a good idea to opt-in as long as the township has the option to opt-out in the future. But he voiced the concern that if the township opts-in and then turns down a developer who wants to develop a site such as the Sheraton Crossroads property at the northern end of the township, that developer could sue the municipality for denying its development plan. Burgis responded that it is his understanding that if the township opts-in to the Highlands plan, the Highlands Council would protect the township from such a lawsuit. Before the non-binding straw poll of the council, DaPuzzo said, “COAH scares me more than the Highlands Council, so I am for opting-in.” Mayor Martel said he would like more time to consider the action, although he had no objection to eventually opting-in to the plan. Martel advised the council that he had talked to two municipalities that were not opting-in because they found the Highlands Regional Master Plan too restrictive for residential properties. But DaPuzzo said those municipalities are concerned about future tax ratables from a number of open tracts of land in their communities, while there are less than 300 acres of developable land in Mahwah. The township must indicate to the Highlands Council its intention to opt-in to the Highland Council Regional Master Plan by Dec. 8 and must submit its COAH Housing Element and Fair Share Plan to meet COAH’s third round affordable housing regulations by June 8.
