McMahon An ordinance adopted by the Mahwah Council authorizes the township to sell two vacant lots on Eastview Drive to the highest bidder among the contiguous property owners. The two lots are vacant and contain less than the minimum size required for development under the township’s municipal zoning ordinance. Neither lot currently contains any capital improvements. They are part of a series of small lots that extend along Eastview Drive northward to the New York border. The township also owns several larger lots nearby that front on Crest Road. The two lots on Eastview Drive were appraised as excess land and as lots that are not buildable. A minimum price for the sale of the two lots was set at $45,000. The deed that will be given to the successful bidder will contain a restrictive covenant that will require that the property be used only in conjunction with a contiguous property and which will prohibit any use of the property to create a newly subdivided lot. Last year, the township received an inquiry from Ramapo Valley Road residents William and Linda Dator about the potential purchase of the lots. These residents own the adjacent eight lots, which extend to the New York border. Township Administrator Brian Campion told the council that the township-owned lots are undersized, and he recommended that they be sold. William Dator told the council in October that he wanted to buy the two lots so he could make the driveway on his property shorter, and allow a larger home to be built on his property. State law permits the sale of real property owned by a municipality at a private sale to the owner of property that is contiguous to the land being sold. The township’s action is based on that statute and the fact that the lots are no longer required for public use.
