McMahon The Mahwah Board of Adjustment has granted a request by the attorney for the owner and the tenant of a Lakeview Drive property to delay the public hearing on their application, which seeks the board’s confirmation that the string of wooden coops on their property predates the zoning ordinance. The public hearing has been carried to the board’s Jan. 20 meeting. George Cotz, the attorney who represents property owner Rommel Mondejar and tenant John DeMarino, made the request when he realized that four of the regular members of the board were not present for the hearing. Cotz advised George Cimis, the board chairman, that he would prefer to present his case to the full membership. Mondejar and DeMarino allegedly have about 500 roosters and hens in the coops, which are currently within five feet of the property line, in violation of the zoning ordinance. However, they claim the zoning ordinance does not apply to them because their use of the property predates the local law. They had previously been in municipal court in response to numerous summonses issued to them by John Lane, the township’s previous property maintenance officer, and by Thomas Mulvey, the current zoning and property maintenance inspector. Those summonses were issued in response to complaints by neighbors.
