McMahon A three-judge panel of the Appellate Division of the Superior Court of New Jersey has heard oral arguments from the attorneys representing two Mahwah couples and the township’s attorney concerning Superior Court Judge Robert P. Contillo’s September 2008 dismissal of the residents’ lawsuit against the township. That suit challenged the township’s right to continue to use fire sirens as a means to summon firefighters. The oral arguments were presented by Charles X.Gormally, the attorney for plaintiffs Christopher and Dawn DiLeone, the neighbors of Fire Company #3 on Rozanski Lane, and Emilios and Dr. Vasiliki Saitas Kokkinos, the neighbors of Fire Company #2 on Island Road, and Township Attorney Terry Bottinelli. The Appellate Court panel consisted of Judge Jane Grall, Judge Laura Lewinn, and Judge Dorothea Wefing. The couples filed the original lawsuit in April 2007 in opposition to the use of fire sirens in the township. In the subsequent trial, they claimed the sirens constitute a nuisance and asked the court to stop the township from using them. Contillo dismissed that part of that lawsuit without prejudice, which means a subsequent lawsuit on the same cause of action would not be prohibited, because of the potential that advances in technology could obviate the need for sirens in the future. He dismissed with prejudice the claim that the noise levels of the sirens constitute noise pollution that causes the impairment of the environment, and that dismissal prohibits a subsequent lawsuit on that same cause of action.
