He said the new service station will remove all trucker amenities from the site, including the motel, overnight parking, laundry, truck repair, and truck washing uses. Truck parking will be reduced from 80 spaces to eight, and long-term truck parking and idling will be prohibited. Mulligan advised that Pilot will undertake a variety of environmental cleanup measures, including remediation of any soil and water contamination on the site, and Pilot’s plan will close access to Ridge Road and thus completely segregate the site from the schools on that road, providing for a greater distance between trucks and the schools, and eliminating all conflict between Pilot site traffic and the students, staff, and parents at the schools. “The board’s vote affirms the value of this development for Mahwah,” said James Lott, Pilot’s attorney. “Pilot looks forward to continuing to cooperate with the board and the Mahwah community as we work to develop and better the site.” Kevin Moore, the attorney representing Paks Fast Service, Inc., the owner of the Valero service station located north of the Pilot site, which has opposed all of Pilot’s attempts to renovate or expand its site, declined to comment. Ira Weiner, the attorney for Parents for Safety LLC, which was created by parents of children who attend the schools on Ridge Road in opposition to the Pilot plan, voiced his disappointment and disagreement with the board’s decision. “We’re certainly disappointed with the ultimate decision,” Weiner said. “We certainly respect the board’s consideration of it but, at the same time, I think they made a terrible mistake. The design is a very bad safety hazard and, in fact, I believe they applied the wrong standard in that this is a prohibited use that is prohibited on this site and it should have been treated as a prohibited use. I think it is ripe for court review.” Pilot plans to remove an acre of the pavement, eliminate 90 percent of the existing truck spaces, and construct a 4,282 square foot convenience store building on the site, along with a 12-station car fueling area with a canopy on the north side of the property and a six-station truck diesel fuel area with a canopy on the south side. The Ridge Road access to the site will be closed and various plantings, trees, and shrubs will extend along the Ridge Road frontage along with an eight-foot high climbresistant chain link fence.
